While ESPN’s Bobby Marks stated that the Heat were likely alerted to the league by a rival club, NBA analyst Marc Stein provided a significant update on the probe on August 10.
The odds of the NBA unwinding Lowry’s sign-and-trade are “low to none,” according to Stein, which is clearly great news for Miami’s front staff.
“’Unwinding one of these deals, to use the insider term for dismantling an NBA transaction, is probably the only measure that the league could take to truly dissuade such overt rule-breaking,” Stein writes, but no one he’s spoken to in the last few days expects the “sign-and-trade” to be rescinded after it was “publicly announced as complete.”

Stein also emphasized that Miami is being investigated for “gun jumping,” not tampering.
While tampering “typically refers to a front-office official, coach, or player attempting to persuade a player under contract with another club to join their franchise,” gun jumping is not the same.
To clarify, the Heat are being probed for “gun jumping,” not “tampering,” regarding the timing of Lowry’s motion. The procedure, according to what I’ve been informed, will almost certainly not “unwind” the purchase, but may include a draft selection, penalties, and punishments. “At least a couple of weeks,” the procedure is expected to take.

The distinction was addressed by NBA general counsel Rick Buchanan, who recalled the Bucks’ penalty for attempting to acquire restricted free agent Bogdan Bogdanovich from the Sacramento Kings. Milwaukee was fined $50,000 and a future second-round selection was deducted by the NBA, which voids the deal.
“The idea is that the flag for free agency goes down at the same time, and everyone should start having those discussions at the same time for competitive reasons,” Buchanan said. “This isn’t about messing with the system.
“Tampering is a regulation that prohibits you from making improper contact with a player who is under contract with another club. So [with the Bucks], the infraction was that the club had discussions with the representation for this player about a free-agent deal before the CBA allowed them to do so, and as a consequence, they were penalized.”
Miami’s efforts to acquire Lowry before the trade deadline will almost certainly assist the Heat in avoiding serious charges.

Because the Heat came close to acquiring Lowry before the March 25 deadline, talks that were completely lawful at the time, Miami’s case is distinct from the Bucks’ infraction. S
“According to an NBA party familiar with the league’s tampering investigation, the Heat’s maneuvering for Lowry differs significantly” not only from the Bucks, but also from the NBA’s investigation into the Chicago Bulls’ acquisition of Lonzo Ball, which occurred one minute after free agency officially began.
“Unlike the Ball scenario, the Heat had previously been engaged in lengthy discussions with the Raptors about Lowry’s availability at the March 22 NBA trade deadline,” Winderman said. “With the NBA looking into the timing of the Miami Heat’s sign-and-trade deal with the Toronto Raptors to acquire free-agent guard Kyle Lowry, many mitigating circumstances seem to be in the Heat’s favor.”
“An NBA source verified to the South Florida Sun Sentinel that the Raptors spelled out possible trade conditions at the time, with it being apparent what the financial parameters would be to sign Lowry in free agency.”
Miami may dispute the NBA’s inquiry by claiming that the Heat, Raptors, and Lowry reached an agreement quickly since all of the deal’s complex details had been negotiated months before.
